JPune
Hi All, My H1 B petition was filed last year and the receipt date is October 14, 2012. I received RFE on the same in Feb 27, 2012, and through premium processing responded to the RFE on May 18, 2012 and finally got my petition approved on May 29, 2012. And when i received the I-797 B notice, the validity mentioned in it is from 10/01/2012 to 09/30/2013, which means i cannot travel before October 2012, where as i am supposed to travel as soon as i get my visa stamped. Please help me understand: Since my visa was filed last year in 2011, how can i get the validity only from this year, October 2012? Please help me understand the actual rule. Also if it's a mistake on USCIS's front, can the I-797 B notice be rectified and what is the procedure for the same? Would really appreciate for the responses asap. Thanks in anticipation. Kind Regards. Link to comment

livliv
Your employer needs to do that. It is their petition. Link to comment
wiweq
You should have counted towards last year’s quota; it’s a mistake from USCIS side. Ask your employer to contact them. They filed it, they paid for it, they will fix it. Link to comment
