You need to have a sponsor file a H1 for a job available to you. First comes the job offer and then comes the H1. Does your DSO know that you are not working as of now and is he all right with that scenario? Link to comment

JoeF Posted June 1, 2012 Report Share Posted June 1, 2012 You can only be unemployed for a limited time on OPT. When the OPT expires (assuming you have a job), you have a 60 day grace period. If an H1 is filed during that time, for the 2014 quota, you can stay until the H1 starts, but you can't work until Oct. 1. But again, if you don't have a job on OPT, you would have to leave way earlier, due to the limited time you can be unemployed on OPT. Link to comment

Attorney_10 Posted June 1, 2012 Report Share Posted June 1, 2012 Generally, the first day that a cap subject H1B petition may be filed is April 1 for an October 1 start date. Generally, petitions may be filed while an F-1 student is in his/her grace period but s/he may not be able to continue to work until the H1B takes effect.
