H4 Visa Procedure

Hello All,

First of all i would like to thank all those persons who are helping out people attending H1B Visa's.

I Have been working on OPT for the last one year and got married recently. My Wife has been rejected F2 visa twice. Recently my employer has filed my H1B and got approved for three years. My start date is oct 1st 2012. I wish to apply H4 Visa for my wife. Can any one please let me know whether my wife can attend a H4 Visa next month with my approved I797. or whether she has to wait for some time and then attend for interview.

I have noticed on the uscis website that one can attend H1B interview 90 days before the start date and enter USA 10 days prior to the start date. Will this apply for H4 Visa also. I appreciate your help and thanks in advance.

You are correct. In this case have her come over after you are in H1 status, say oCTOBER2.
