Due to some situations, am planning to switch to company Y in india. 1. would I be able to use(transfer) my h1b after stamping? 2. If yes, would the process be simpler or it is like new h1b petition? 3. please reply me if there is any use in h1b after changing the current employer without travelling to US. Also clarify if there is any time frame. Thanks in Advance. Note: This may be a FAQ. but am not able to find my situation. If u r not able to reply, plz give me a link specific to my situation. pontevecchio Posted May 30, 2012 Report Share Posted May 30, 2012 Every time you change employers they have to follow the process of filing a H1 petition and getting it approved as before except that you have been cap counted. The previous company HAS to revoke the H1 petition by law. The visa is not a petition. Do you understand? Link to comment
