krishna9 Posted May 24, 2012 Report Share Posted May 24, 2012 My employer is planning to revoke/withdrawl 140 based on some problems.. and he also has applied for 7th year h1b extension and he was saying it will automatically revoked as the 140 is revoked/withdrawl.. my labor is approved so what are my options to stay in US and how long can i stay in US.... once the 140 is withdraw will my labor also be withdrawn automatically? Is there a possibility that i can change the employer with the approved labor even though withdrawl of 140 by current employer.. Someone please help me with situation. Link to comment

Basically once the I-140 is not filed within 180 days of PERM approval or if the I-140 is withdrawn and/or revoked the PERM is no longer of use to you. Is your I-140 approved or not? Link to comment

You can retain the PD if the I140 has been approved for more than 180 days. Your options are to either leave or change to some other type of visa/status. Link to comment
