sp_0826
My wife is travelling to India with an approved GC and will be staying in India for almost 4 months. Questions: 1. Is there any problem because of the length of her stay (4 months) outside US ?? 2. What other documents would she need at the POE ?? Appreciate your responses. Link to comment

redgreenbluee
please consult a lawyer. she will only need her GC (and passport) when entering the US, being outside for 4 months should not be an issue. goodness123
Your wife wont have any problem if you are out of countryfor more that 4 months . Infact technically one is fine to re- enter till about 11 months and 29 days with out effecting GC status in anyway. The immiration officer cannot stop your wife from entering back to to US if she enters before 11 months and 29 days , they might ask her few questions but they cant stop her Link to comment
pontevecchio
" Infact technically one is fine to re- enter till about 11 months and 29 days with out effecting GC status in anyway." Dangerous and erroneous words. Stays up to 6 months are fine. 6 months to one year may lead to a rebuttable presumption of loss of the PR which would need to be overcome with evidence as appropriate to their satisfaction and not a slam dunk. Stays more than one year will lead to loss of PR. Link to comment
