H4-H1 cos if denied will i maintain my H4 status till 2013

Hi all,

Thanks Joef & pontevenchio for giving answers to most of my questions.

I have a situation here.My H4 is valid till july 27 2013.Now a employer is ready to file from H4 to H1(I have a old H1 which expired in 2011 sep (first 3 years).).

If a COS from H4 To H1B is filed & if its denied can i still maintain my old H4 status (till 2013) or what will Happen to my status..Pls let me know bcas this is very important to me before i proceed to the COS.

If the New H1 petition with COS from H4 is denied you will continue to be in H4 status as before.

If a COS is denied, you remain in your current status.
