I had my labor and I-140 approved and now my Client wants me on Full-time basis and is willing to get my H1B transfered and sponsor GC as well. So, the question is how would I get my extension(no:of years) once the span of 6 years is completed? As the GC process would begin with new employer from the Step 1and as I had my I-140 approved with the old employer, will I get the extension for 3 years as before or will it be only on year-year basis, in case if I do not get my I-140 approved with the new employer by the end of 6th year. kalyan_ac Posted May 3, 2012 Report Share Posted May 3, 2012 With less than a year left on your 6 yr term, i doubt if you will have your I140 approved with your new employer. Make sure you file your PERM at least 365days before the expiry of your h1 so that you will be eligible for 1 yr extension. Link to comment
