anandgs Posted June 24, 2011 Report Share Posted June 24, 2011 Mine is EB2 case with PD very close to be current and my 140 also approved in 2008. My EB2 petition salary is 80k. My current H1B LCA is 72 k, all these years (2006-2009) my w2 are in the range of 80-90k,because of break in porject for couple of months in jan and feb/2010 my company maintained salary of 60k(i.e 5k/month) to compensate the extra payment in jan and feb,from july on words they agreed to make more payments as per H1B LCA. Will this be problem at 485 filing ? Thanks Link to comment

veni001 Posted July 1, 2011 Report Share Posted July 1, 2011 USCIS could ask your tax returns. For one to maintain H1B status must get paid at least LCA wages. Irrespective of your GC filing you should be able to show your wages are always equal or more than LCA wages shown while on H1B status. Link to comment
Belle Posted July 3, 2011 Report Share Posted July 3, 2011 It depends on your filing. To prove eligibility, you don't need paystubs, but you may need those to prove admissibility, i.e. that you were in status when you filed I-485. Link to comment
