sachinsvt
I am on H1B Visa. I am fired. How much time I have to transfer my H1B? My employer has cancelled my H1B visa at the day of firing me. Please let me know. Thanks, Sachin Link to comment
JoeF
There is no grace period. You are out of status. Link to comment
JoeF
Oh, and if you want to return to your home country, the employer by law has to pay for your flight (not for dependents, though.) Link to comment
dreams11
I think you have 30 days period to file or transfer H1b to another company. Link to comment
sachinsvt
Thanks for your reply. I'll ask to my employer to give me return fare. Do you know, who much time I have to transfer my visa, if I want to stay. Thanks, Sachin Link to comment
vidhu123
I am in the same situation. I am trying to move to F1 or B2 but its very confusing. Link to comment
JoeF
I think you have 30 days period to file or transfer H1b to another company. There is no grace period. While CIS may accept transfers within 30 days, there is no guarantee. It is always best to stay in valid status, e.g., by immediately filing for COS to some other status, e.g., B2. Link to comment
wiweq
dreams11, please don,t advise false information. As Joef said, there is no grace period once you lay off. You are out of status right from the next day of lay off. Act fast and file COS asap. My COS was denied as I filed for H1b to H4 after 7 days of lay off. Now they terminate the h1b electronically which takes few hours, earlier it was taking 3 -4 months to terminate an H1b. Link to comment
SameerH1Bworker
There is no grace period for anything, not even for H1B transfer or Change of status to B2. The very next day after your job ended, you'll be accruing out of status days & once it reaches 180 days total then 10 years bar will apply. So, better to contact better attorney right away or leave the country immediately. Link to comment
