lattieAGM Posted March 23, 2012 Report Share Posted March 23, 2012 With Company A, I have 4 years and 9 months experience. I joined Company B and have been working for 1 year and 9 months. Company B filed EB3 and I have I-140 and H1B extension for 7th, 8th, and 9th year, both approved. Question #1: Can I go back to company A as H1B transfer? Question #2: If Company B files a brand new GC with EB2, would my previous work history with Company A be qualifying for EB2? Link to comment
Jyothis Posted March 23, 2012 Report Share Posted March 23, 2012 #1 sure you can take up another position with A #2 I believe you can get EB2, if your new position with A is significantly advanced compared to the old position you held and qualifies for an EB2 level on the job requirements. Personally, I would be hesitant to go back to my old company - but it may be just me ;) Link to comment
