RFE on H1B transfer. About paychecks!

Hi,

I am in States and transfering from company A to company B under premium process. I have put vacation in comp. A and receiving paychecks. Now my comp. B also wants to run paychecks and my h1b trasfer is still under process and received RFE.

What are the problems with this? Can my comp. B run paychecks before H1B visa approval?

Any help is greatly appreciated.

You are eligible to get only one pay check by only one company. And yes you can join company B and get your pay check run by him before the H1 transfer gets approved. Company-B can run pay check on just the receipt of the acceptance(not the approval) of H1 transfer Application by USCIS.

Since you can only draw pay checks from the company that sponsors H1b, it would be illegal to accept second set of paychecks. Wait for H1 to finish then formally resign from the first one and stay legal.
