cpandran
My final NIV date on H1B is Feb 2013 and after recapturing the time I was not in the US, it is till Apr. My company attorney said that they will be filing my PERM before Apr of this year. My Visa and i-94 however have the expiration date as June 2012. If Perm is going to be filed soon, what would be the document to show me in status in the US? Link to comment
Jyothis
You will need to file for your visa extension at the earliest. Contact your company attorney and speak about this. every case is unique and your attorney can provide the right answers on this. Link to comment

Generally your I-94 date is based on your I-797 and not Visa. You can stay in US as far as I-94 date(=I-797 date), even if Visa has expired. But if I-94 date at POE was given shorter than I-797, it may have been POE mistake, and you may have to get it fixed. Link to comment
