sk8er Posted March 2, 2012 Report Share Posted March 2, 2012 Hi, My consulting company applied for PERM 3 years ago which got denied because of degree mismatch ( they used my incorrect graduate degree for a job in another field ) and because they advertised job in an unknown publication. My question is 1. how should we be careful now if they decide to apply for PERM and do not want to get audited ( and given that I donot work for them ) ? 2. what steps should we have for I-140/I-485 if I am not working for them ? Do I have to work for them in the future ? 3. If they mess this one up would it redflag me in some immigration system forever ? Link to comment

You have to work for them when the GC is approved. But the company has to have the job available for you at all times, and they have to have the financial means to pay the salary. Given that the company apparently can't even afford a decent lawyer to make sure applications are done correctly, you probably should look for another employer. Link to comment
