pvkprasad Posted February 7, 2012 Report Share Posted February 7, 2012 Hi I came on L1B in December 2008. My L1 was extended in September 2010 while my family and I were in the US. My company is in the process of filing for my Green card and I currently getting the Job description finalized with the lawyers. My wife may have to travel to India this summer if my mother in law may be getting operated. Since she will have to get her visa stamped when she is in India, I have the following questions - 1. Is it going to be a problem for getting the L1 visa stamped in India, if my green card papers are filed with the USCIS? Is there any risk of the visa not being granted because of the Green card processing? 2. If my wife's trip is necessary, should I hold back on the Green card application till she is back from her trip? Please advice Regards Prasad Link to comment

Could you also please respond to the question of travelling out of US on L1 extension papers while the green card is being processed and to get the visa stamped before travelling back to the US? pontevecchio Posted February 7, 2012 Report Share Posted February 7, 2012 The L21 visa will not be denied because you or her have shown Immigrant Intent. In any case she will show such intent when she applies for AOS and not before. The only factor relevant to her L2 visa is the credibility of your L1 status. Link to comment
