Principle applicant changed H4- Can we file 485/EAD

Hi Experts,

Recenelty I came to India for my father funeral. My h1b got denied at Kolkatta embassy. I applied for H4 and got visa approved. My 140 approved when I was on H1B, I have been is US for last 6 years. Never out of Job.

When my H1b denied, Visa officer sent petition to Kentuky Consular centre for revocation,

My PD is December 2008

I am the primary applicant for my green card, my wife is on H1B

As my date current can I apply 485/EAD/AP with H4 status after coming to united states? What is the risk involved.

H1 Denied! Is this means you lost your job with GC sponsor?if you have job with your GC sponsoring employer at the time of GC approval or changed job using AC21, you should be fine. No need for H1 to get GC.
