Before H4 visa i was having a valid H1B visa but due to some issues i was not able to travel USA on same. When i went for H4 stamping in consulate they cancelled my H1B visa by crossing with pen and issued me H4 visa. My H1B visa also got expired on september 2011. My question is that whether on that cancelled H1B visa i can file extension and get a working status in USA or anything else can be done for getting me working status in USA.Thanks in advance. pontevecchio Posted January 30, 2012 Report Share Posted January 30, 2012 The visa is ONLY an entry document. You can have an employer file an H1 with COS from H4 nand start on approval. You will need the visa for foreign travel as it is needed to come back. Link to comment
Chitown01 Posted January 30, 2012 Report Share Posted January 30, 2012 Since you had an approved H1 petition in the past you are Now CAP EXEMPT.... if you have a new employer in the USA they can file your H1 peittion as CAP EXEMPT and apply for COS.
