Visiting India before H4 extension approval

My husband( H1B) and me( H4 ) applied for visa extension on Jan ,2012. My old i94 is upto Feb.

1. Can I go to India before Feb ?what are the problems associated with this?

2. Can I go to India after Feb ?

3. Does my India trip causes any RFE for my husaband's H1B extension?

4. If I go to India after Feb, my H4 visa extension will get cancelled. Does it cause any problems in future?

His H1 has no connection to you. In order to return you need a valid H4 visa and his extended petition.

1. Yes, you cannot return until decision on extension petition has been made. You might need stamping as well.

2. Yes, since your extension was filed in timely manner you have upto 240 days to stay in US till you hear about the decision on extension

I think it is better that you can go to India after your H4 extension is done.

Few options.

Do premium processing for H1, if you want to go to India and it is urgent to go in Feb.

Only problem, if you leave to India now is, you have to get your Husband H1 approved to come back to US.

If it is not urgent to go to India, better wait until your husband H1 ext is over.
