chiidcare Posted January 26, 2012 Report Share Posted January 26, 2012 I am in my 5th year of H1B, expiring JAN 2013. I have an I-140 approved in EB2 category. I got lay'd off from my company yesterday. If a company is ready to transfer my H1B, would they be able to get 3 yrs extension based on my approved I-140? Is the new company suppose to start my PERM process right away to get this 3 yrs extension or they can wait and then apply? Also, do I have some time to apply for Change of Status (I-539) or do I need to do that right away? Thanks Link to comment
