I accepted the offer from company Y and they filed for my H1B transfer in premium processing. The effective date on the approval notice says 30th Jan 2012. I need 2 weeks notice period with my current company to resign and that will put my start date to 10th Feb 2012. Can i continue to work on my current H1B till 10th Feb even though the effective start date on the petition with my new employer mentions 30th Jan. Is there a grace period within which i have to join the new employer after the effective date on the petition. Please clarify urgently. Manas Link to comment

venkat_ead Posted January 26, 2012 Report Share Posted January 26, 2012 DOL web site says 30 days if u r travelling from different country( india) and reporting in usa. 60 days if you are moving with in USA( these 60 days you need to have your payroll run) this is for only H1-H1 if you are on L1 or any other visa than H1 , there is no grace period, your status will be converted h1B and you need to start with new employer as soon as possible,.
