My company in India has applied for a H1B in consular process instead of a status change from H4 to H1 B...In this scenario i have been asked to travel to INDIA for stamping ...is there anyway to handle this situation without going out of USA ? pontevecchio Posted January 21, 2012 Report Share Posted January 21, 2012 Since the company wants you to get the visa you have no choice unless they want to refile the H1 with COS with the money implications. Why is the visa a problem? Presumably a known Indian company? Link to comment
Chitown01 Posted January 21, 2012 Report Share Posted January 21, 2012 To start working on H1 you will have to leave the country and re enter on H1, since you dont have h1 stamped already, you will need to go for stamping... You can go to canada as well, but then there is risk involved in doing so, its better to go to home country for visa stamping. Link to comment
