sh21
Currently I am with employer A and have got offer from employer B, I haven't resigned from employer A. Suppose if visa transfer to employer B is rejected/denied can I still work with employer A since I haven't informed/resigned from them? Link to comment
pontevecchio
You mean Petition when you say Visa. If you continue to work for A while awaiting the H1 approval via B it makes no difference if the H1 from B is denied. Link to comment
rohan323
This was the same question I was going to post as well - so if transfer in my 9th year of H1 (am on Green Card labor) from Company A to Company B gets denied, my status with Company A does not change as long as I have not resigned. Is that a correct assumption. I am also hoping that no one in Company A gets to know about the transfer process. Link to comment
pontevecchio
@rohan Thats correct. A will not know. But you do know you will need an EVL in response to an RFE? vis a vis the GC. Link to comment
venkat_ead
As long as you have valid H1B and you not resigned from them you can work with them Link to comment
