anmadh Posted January 12, 2012 Report Share Posted January 12, 2012 Hi, I have approved I-140 with company A and I am in 6th year of my H1B (which is till Aug2012). I am planning to move to another job. I am aware that I can retain the old PD, but my question is if my H1 is transferred to a new company, will the fresh petition be for until Aug 2012 or Aug 2015 (incl the 3 year extn) ? Or do I need to file 3 year extention again in Aug 2012? Link to comment
schintala Posted January 12, 2012 Report Share Posted January 12, 2012 As you have approved I140, you are eligible to get 3 year H1 extention. It doesn't matter whether your I140 belong to A or B. Link to comment

momof1girl Posted January 23, 2012 Report Share Posted January 23, 2012 please correct me if I understand it wrong - he has to do a h1b transfer in his 6th yr to the new employer. within that transfer the future employer can request 3yr in addtiional starting from the ending date of 6th yr. it works like a transfer plus an extention. And it doesn't matter it will use the 140 from previous company. Thanks Link to comment
