Need to know the possible risk/issues for applying H4 visa while the H1B holder is eligible for last stage of green card

Hello,

I will be appearing for H4 visa in the last week of Jan 2012. My husband is working in a mnc in US with vary good brand name. Currently he has approved H1B visa and his green card is in process. He is eligible for I-485 and will be applying for the same as soon as I reach US. I want to know the possible risk/issues for applying H4 visa at this stage. Will his green card process create any issue for my H4 visa?

Please advide/comment if anyone has faced same situation.

When USCIS receives your I-485 both of you should be present in US.

Interesting question. I would like to know the answer to this as well, as I am also in the same situation.

Anything to keep in mind while attending the H4 visa interview ? Will spouses Green card appli create an issue for H4 or vice-versa.

Since H1/H4 is dual Intent there are NO risks because of the pending GC.

I got my visa approved on Jan 30 at Mumbai Consulate.

Following are the question asked to me:

For how much time your husband is working with X organization in US?

Do you know his designation?

When and where was your marriage?

How did you people meet?

Who arranged your marriage?

When did you meet?

Were you both in contact till marriage?

How many people came to your marriage and reception?

Which is native place of your husband?

Which is your native place?

He has only checked my I797 form and no other document he asked me to show.
