But lets assume the moment i put in papers with the current employer once the new COS approved(may be by June'12) with notice period of 3 months and if the employer teriminates/reduce the notice period/forced me to go offshore?Can i stay until Oct1st if i got teriminated/refused to go to india? vinodisback Posted March 5, 2012 Report Share Posted March 5, 2012 Hi, Current I am on L1 visa and applied for H1B, for which I got RFE and my employer has responded to it. Since I travelled to India during H1B application period, my COS will be void and I will be getting H1B without COS. So my question is, how long it takes for COS application process (assuming I will be applying for COS after my H1B approval)? Also, can I apply for COS with premium processing?
