vgk_la Posted December 13, 2011 Report Share Posted December 13, 2011 I got the refusal letter from US consulate with the following reason: Your petitioner does not appear to be either able or willing to provide qualifying employment in the US in accordance with appropriate laws and regulations. what is the probability of USCIS re-affirming my case with this reason? I have already worked with the same employer more than 6 years ...How do they say now this reason? Link to comment
pontevecchio Posted December 14, 2011 Report Share Posted December 14, 2011 USCIS may very likely reaffirm petition approval. The question is not about the Consulate refusing to issue a visa. The question is about your employer not providing specific relevant docs for some reason. Even if reaffirmed the visa may not be stamped and in any case that takes 9-12 months. A lawyer may be of great help. Also finding a new H1 sponsor may do the trick. Link to comment
