Hi!

I moved to the US recently, to join my spouse. And now I intend to look for a job.

Let me put my case in a nutshell.

• 3 years of experience
  
• Have had a H1-B in the past, which was not utilized, which is now invalid as I'm currently on H4
  

I understand that the cap has been reached for this year and ideally I'd have to wait until April to even apply for a H1.But I also heard that the cap is not applicable to folks who've had a H1 in the past.

Do I have any advantage because of the past H1-B in my record?

Is your H1B petition still valid I mean the Expiry date ?

Hi .... it expired on Dec 12. It was given only for a year, because of project requirements.

Does that matter ?

The expiry date is Immaterial. You have been cap counted and hence eligible for non cap H1 petition filing..

What do you mean consultants? There are many **********, ****, ********* , ***********, etc etc., Look at their websites or on linked in you might find open positions. Once you apply, get interviewed and get in they can process your h1 ( cap exempt).
