My 6th yr H1B ends in Dec 2012, EB2 I-140 approved, and I-485 not filed bcoz of PD not current. I want to move to a different employer in the 6th year. My plan is to ask the new employer to file for H1B 3yr extension based on old employer I-140. The question is how early can I move? Can my new employer file for existing H1transfer, and new 3yr extension in Jan/Feb 2012? Link to comment
