Expired I94 , Valid H1B , Need Urgent Help !!!

Hi Experts ,

Need your help on my case.

H1B Valdi until March 2012

Passport Expired on Oct 21 2011 and the I94 expiry date was also Oct 21 2011 so has expired. I have a new passport now but my HR says i have overstayed. What would be the next step tp resolve this issue without delaying to avoid out of status for too long.

Please advise.

If both Visa and petition are valid, all you need to do is leave the US and return. Canada or Mexico will do as long as you submit the current I-94 when you leave and obtain a new I-94 after returning.

Leave the country and return with a new I94. If you are in SOCAL you could go to the Mexican border near San Diego and return with a new I94.

If you have a visa for Canada that would work . In case you do not have a visa for Canada or Mexico you can still cross over at the Tijuana border.

Salinasbrad- Did you go to mexico and got a new I-94. Mine is a similar situtaion but I am close to 180 day period. Please share if you were able to cross the border and re-enter successfully.

Prv1981 , I still havent travelled yet as my compant had filed for my H1b extensuon and thought they might extend my stay(i94) too.

But USCIS just apprived my new petition but not i94.

Experts need your help again. I am closing in 90 days on Out of status now. What can i do next ?
