krishna5555 Posted November 12, 2011 Report Share Posted November 12, 2011 My visa in passport got expired but has a valid h1b visa, which has the same I-94 number attached to I-797 form. While leaving USA I submitted I-94 (white) form to airlines but forgot to submit I-94 form attached to I-797. I am planning to go to H1B visa stamping in India. Could you please let me know if this causes any issue during stamping or reentry to USA. Can I submit this when I re-enter USA. Need your help urgently. Link to comment

leman Posted January 20, 2012 Report Share Posted January 20, 2012 In past I have made similar mistake. Since then, I did multiple in and outs. So far no issues.Currently I have pending 485 case.If this pending is approved, than it will prove that it has no impact. Link to comment
pontevecchio Posted January 20, 2012 Report Share Posted January 20, 2012 As chitown has correctly pointed out CBP has changed its guidance and now their position is that if people leave by Commercial Airline the I94 does not have to be returned anywhere if one forgets to submit it on departure.
