lostpacket Posted November 4, 2011 Report Share Posted November 4, 2011 Hi, My h1b visa was refused in Delhi. The petition was sent back to USCIS for review. During the USCIS review, the petition got expired but they continued to review it. My employer filed a new h1b under premium processing and got it approved. With that petition I went to Mumbai consulate. Even there they denied giving visa giving reason that my previous visa application was refused in Delhi and I should wait while USCIS review is done. Guys, if USCIS can approve new petition when previous one is under review, why does not consulate approve the visa based on new petition. I would like to know if contacting congressman is a good idea. The lawyer is reluctant to take any further steps and company has already started looking for replacement. Please reply... pontevecchio Posted November 4, 2011 Report Share Posted November 4, 2011 The congressman has NO standing. Get a different Employer to file your H1. Then you will get the visa. As far as the present employer is coincerned it is his job to sort it out and not yours. Link to comment
