rose_koool Posted October 11, 2011 Report Share Posted October 11, 2011 All, I went to India during my H1B extension process and while I was in india my H1B extension got approved. So while re-entering USA POE I had the old I-797 along with me ( The new I-797 was in my USA address). So the officer in the POE issued a I-94 that matches the old I-797 which I could produce to the POE officer. Now in my new I-797 there is another I-94 attached to it. So Now which I-94 expiration date would be applicable for me. If the date on the I-94 given at POE applicable to me then whats the solution to solve this issue? Please help me on this. pontevecchio Posted October 11, 2011 Report Share Posted October 11, 2011 Go to the CBP and discretely ask for the I94 to be corrected as it "seems" to have been issued wrongly based on the previous petition and not on the current. Do not categorically lie. But imply this is what could have happened. Link to comment

Should I tell the truth to CBP officer that the new I-797 was in my USA address while I was re entering USA so could not produce to the POE office? Have you heard of any successful story in SFO CBP in similar kind of situation? My POE was in SFO, Is it fine If I visit San Jose airport CBP for this correction? Link to comment
