bombayboy1978 Posted October 6, 2011 Report Share Posted October 6, 2011 Hi, This is my position. 1) H1B six years completed. 3 years extension approved till 2013. 2) I-140 approved. Been more than 180 days since approved. 3) terminated from job month ago 4) new employer says I-140 not portable because I-485 has not been filed 5) new employer says H1B transfer not possible because six years have elapsed. 6) finding a job has become very difficult Old employer has said that they won't withdraw the I-140 nor the H1B for 60 days from August 29th- the date that I was terminated. Right now what should I do? Should I apply for change of status from H1B to B1 so I can wrap things up because I have only 23 days to go before they withdraw the files. what other alternatives are there for me? pontevecchio Posted October 6, 2011 Report Share Posted October 6, 2011 You should discuss your facts with a good Lawyer. The new employer is WRONG to say H1 extensions cannot continue. He obviously does not want you to work there for whatever reason. Find a new H1 sponsor . Irrespective of what you do first discuss your situation with a Lawyer. Link to comment
