I am currently working in the US on my OPT which expires at the end of May, 2012. Once we have been married and I have submitted my AOS paperwork am I eligible to work while it is being processed or must I wait until I have received the EAD? I.e., if we were to submit the AOS in April but not receive the EAD until June (after my OPT has expired), would I be eligible to work while the AOS application was being processed? We are trying to determine when is the latest by which we can be married and submit AOS? Thank you for all of your help in advance. Link to comment
JoeF Posted October 1, 2011 Report Share Posted October 1, 2011 You must wait for the EAD to arrive. You are legal to stay in the US after the I-485 is filed, but to work, you need the EAD in hand. Link to comment
