unmarshall Posted May 12, 2011 Report Share Posted May 12, 2011 Hi, My employer has filed for my H1 Extension on 29th March (as per USCIS site. It's been 1.5 month and status is Initial review. My I94 expires in 13th June 2011. Can i stay in US till i receive the status of h1 extension? also last month, I got married to US citizen girl and we have not filed for my permanent residency. We are waiting for my h1 extension. we were thinking that, it's not good idea to run both files(i.e. h1 ext and permanent residency) parallel. Can somebody suggest, whether i should wait for my h1 extension or i should go ahead and file my permanent residency? Please advise. thanks Link to comment

Belle Posted May 12, 2011 Report Share Posted May 12, 2011 If you have a valid I-94 and you are in status, why don't you just file for AOS based on marriage? If your extention is approved, you will remain in H1 status, if not, you will be in AOS. Link to comment
