sm1981 Posted July 15, 2011 Report Share Posted July 15, 2011 797 - expires in Sept 2012 Visa - expired in Sept 2010 I-94 - expires in AUgust 2011 passport - expired but I got it renewed this year. I called the CBP in Minneapolis and they said that they stopped correcting I-94 issues that arise due to expired passports. They told me to get an infopass and visit the local USCIS office. The person at the USCIS office said that I need to file for an extension by sending in the I-539 form. My only concern is that my I-94 will expire before I get a new one and I'll be out of status. I have a call with an attorney today and I should know more. If anyone has encountered this, please help. Thanks ! Link to comment

You would need to have your sponsor file I-129 petition for an non immigrant worker and if filed before the current I94 expires you will be OK. An alternative is to leave and come back with the H1 visa. Link to comment
