addyjerry Posted September 8, 2011 Report Share Posted September 8, 2011 Hi I've been on L1B with my current employer for close to 2 years now, with visa current and expiring in 2013. A prospective employer is willing to sponsor my H1B and file for COS. I dont want to resign from my current employer before all the H1/COS approvals are in place. 1. Can I serve only the notice period (1 month) with my current employer after the COS approval? 2. Any suggestions on how best to go about this? Today's date is 08-Sep-2011, so the H1/COS under premium processing approval would probably come 1st week of October if filed within the next few days. Am I right? The sponsoring company says they can file with a later COS effective date: which will give me the time to submit my resignation and serve my notice period(Once I have the approval notice in hand).
