L1 TO H1 TRASFER ( YES OR NO)

Am explaining my situation below.Plz advise.

Am on L1 with employer A ,from 2 years.

My project is over in us and am heading back to india in sept 15 2011.(L1 expiry is 2013).

Now company B is ready to convert my L1 to H1 if i stay in india.( COS)

Question is if i apply for H1(premium processing) the earlier i get h1 will be sept 15th.If i get h1 approval can i stay till Oct 1st in usa without a job? Will that be out of status? around 10 days does it matter? i heard from people that when processing GC this can be a problem.Is that true?

You cannot stay in US on a working visa (H1/L1) without a job. Even when you have a job, you must be getting pay stubs to keep your status valid. If employer B is willing to give you pay during your stay, you can stay.

Did you mean USA? Stay away from such people. If your L1 status expires on September,15 you cannot change status to a first time H1 and will need a visa to come back. Is a visa so difficult to get?
