SUBMIT999 Posted September 1, 2011 Report Share Posted September 1, 2011 I am on my OPT now and currently working (Less Pay) , has opt until Dec 4th. I applied for my H1B through a consulting company and H1B got approved. Should I stop the current job from Oct 1st , even if I have my OPT until Dec 4th? If I don’t get the project in OCT, I will be out of status; Can I apply for H4 visa also and make use of H1B when I get the project? Please help I am so confused. Link to comment
pontevecchio Posted September 1, 2011 Report Share Posted September 1, 2011 Your SEVIS would have been terminated and you would no longer be in OPT/F1 status from october,1. If your H1 sponsor does not pay you on reporting to work complain loudly and clearly to the DOL. You have a safety valve. You can always leave and come back in H4 status later on. Play along with him and get a few months wages before dumping him. Your choice of words "If I don’t get the project in OCT, I will be out of status" is unfortunate and wrong. His problem not yours. Can I apply for H4(As I am not in a position to work ) now and make use of this H1B when I get the project (and do the H1 transfer ) Or if I change my status to H4 , do I have to apply for a new H1 later if I want to work?Or can I use the same approved H1B?
