EB3 and layoff

One of my relative is in EB3(PD Jul 2004). He is laid off with 4 months salary(just paid on the lay off day, not on payroll anymore). He is out of job for more than 40 days. Does it affect the GC?

I did not understand your reply. The layoff was based on bad performance. Company provided additional three months Salary. As now there is valid EAD and AP.

Your relative should talk to an experienced lawyer. Just set up a consultation. There are many things, like whether the lay off impacts status, whether your relative even needs to maintain status, whether there is an opportunity to get a job in a similar profession, etc.
