jdblog Posted June 7, 2011 Report Share Posted June 7, 2011 Hi all, I was on h1b since July 2005 to Oct 2010 and then converted to h4 went to india and stamped came back to us on Nov2010 I 797 of h1b got expired on Oct 2010, Before that date my employer revoke my h1b and now i am planing to do job on h1b.could any please let me know if i need to file new h1b for this year and work only after October or i will come under old cap thanking for your time Durga Link to comment
pontevecchio Posted June 7, 2011 Report Share Posted June 7, 2011 You have a total of 9 months available in H1 status and a sponsor would need to file and get a H1 petition approved before you start. Since you have not left the country for one year only the remainder option is left to you. Link to comment
