Reg H4 renewal..

Hi all,

I have question regarding H4 renewal for my spouse. Here is the issue.

1) Applied for H4 renewal (reached USCIS on July 1st)..

2) Went to India coz of family emergency (during end of July )..

3) Returned to US (during end of Aug) with a new I94.

Even before filing a new extension (with new I94), we got the approval (with old I94).

Could anyone let me know what needs to be done?

I will talk to immigration lawyer next week. But want to know the process before talking to lawyer.

The new I94 seems to be controlling. You have to do nothing immediately.

the attorney will probably do the needful.

you need to reapply with the new i-94 recd at poe for the extension and make sure to not leave until you have approval.

I think when you cross the country, you H4 extension will be voided. When you enter back to US you get a nwe I-94 at POE, you need to re-apply with your new I-94.

To be safe side reapply with New I-94. If you stay more than 180 days, you will be marked as in admissible for 5-7 years.

Get a lawyer help and do it ASAP.
