hollowheart Posted July 25, 2011 Report Share Posted July 25, 2011 I have approved EB2 I-140 for future employment from company A. I am working for company B now. Company B just filed EB2 PERM for me in Jul 2011. My 6th year of H1B will expire in September 2011 . My questions: 1. If time is not allowed, can I use my approved I-140 from company A to extend my H1B in company B? 2. If my PERM and EB2 I-140 applications from company B (my current employer)are approved, can I carry the earlier PD from the I-140 from company A. Thanks for help! Link to comment
pontevecchio Posted July 25, 2011 Report Share Posted July 25, 2011 1. Yes 2. Yes. As of today this is USCIS protocol. But if A revokes the I-140 before you can apply for a H1 extension you are in trouble. Hence B needs to file your 3 year extension now by PP. Link to comment
