gwguy Posted August 15, 2011 Report Share Posted August 15, 2011 Hey all, I have a question regarding transferring from h1 to h4 and someday again to h1. 1. My wife is already on h1b. She is planning to leave her job and come on h4 due to personal reasons. What is the procedure for this? Do I have to contact my company lawyers for this? 2. IF 6 months down the line she wants to get back to h1 what is the procedure for that? Can that be done? 3. Does the time on h4 counts towards your 6 years h1b period? 4. Currently she already has h1b visa stamped. If she goes to h4 for few months and come backs to h1b does she need to get the visa stamping done again? Please let me know. Thank you so much !! A sponsor would file a H1 petition for her with COS and on approval she would work for him. 3. No 4. She would need a valid H1 visa to come back when she is in H1 status. Link to comment
