GCLUS Posted April 1 Report Share Posted April 1 Hi, I just obtained U.S Citizenship and planning to apply I-130 applications for my brother and sister. Question - Do I need to submit the I-130 application for my brother & sister along with their spouses and children [ total 4 adult + 3 child] separately? newacct Posted April 3 Report Share Posted April 3 You can only petition your sibling. So you can file an I-130 for your brother and and I-130 for your sister. At the time they immigrate (which they can only do decades from now when a visa number becomes available), the spouse and unmarried under-21* children they have at that time will be able to immigrate as derivative beneficiaries. (*The exact age the children age out depends on the CSPA calculation, so it can be a little over 21.) Quote Link to comment
