Palon
My I-129 Petition just approved for H1B. But I am planning to withdraw H1B processing since my spouse will be in H4 and H4 won't get EAD until my green card process starts. Does the withdrawal have any impact on future visa processing? I plan to process for green card directly in near future. Quote Link to comment
pontevecchio
It is your employer's petition. If you do not join, he is supposed to revoke the petition. It should have no effect on future visas or petitions. Why not decide after getting the visa stamp? That way you will still be considered cap counted. Quote Link to comment
Zodiac System
The last time I checked, it is the employer who withdraw's the H1b petition, since he is the one who has filed it. Quote Link to comment
