Anju2024 Posted February 6 Report Share Posted February 6 I was working on H1B till Nov 2023 and due to layoffs i had to switch to my spouse’s H1 B (As H4 dependent) by end of december. My H4 is still pending. now i have a potential job offer but since my H4 is pending my potential employer is unable to transfer the H1b. I also came to know the my previous employer has revoked my h1b. How do i move to take this new job opportunity? How do i transfer or file for H1. My H4 may take another month or two to approved. JoeF Posted February 7 Report Share Posted February 7 H1 revocation is irrelevant for you. The old employer was required by law to inform USCIS that you no longer work there. It has no effect on doing an H1 transfer. Quote Link to comment
pontevecchio Posted February 7 Report Share Posted February 7 The company can file your H1 petition with Premium Processing and on approval, you can leave and return with the H1 visa. Leaving the country nullifies the existing COS. Quote Link to comment
