AMadhavi Posted February 2 Report Share Posted February 2 Dear All, This question is regarding my H4-EAD, I filed my H4-EAD using company A's i797 , it got approved and I recieved my EAD card with Jan/14/ 2023 as expiry date. But before this EAD expiry, my husband changed his employer say company B, and now he had his latest i797 with July/11/2025 expiry date. I filed my H4-EAD renewal in Oct 2023 using company B's i797 (which is after the EAD expiry date Jan/14/2023) and recieved the receipt not the card yet at this juncture my husband lost his employment and his last working day was Jan 22nd 2024, his employer told that he will file for H1B revocation after the last workind day and now currently serving 60 grace period of H1 and grace period ends on March 22nd 2024. Question is : Will I be eligible to legally work during this grace period until March 22nd 2024 based on the receipt? If not, when I will be eligible to work? As my employer is running pay stubs for me. Our PD is March 2015 in EB3 category, will this trigger any RFE in future for our green card? Please suggest. Thanks, Madhavi Quote Link to comment
newacct Posted February 3 Report Share Posted February 3 I believe the answer is Yes. You can work on your H4 EAD as long as you remain in H4 status, and you remain in H4 status as long as your husband remains in H1b status, and he remains in H1b status until March 22, 2024. Quote Link to comment
