Komali1234 Posted January 30 Report Share Posted January 30 Hello, in my last travel to india, I got my visa stamping done with expiry date Nov 2024. in the port of entry, the I-94 expiry date is given based on my old passport expiry though my I-797 and visa stamp is valid till Nov 2024. Now I got a new passport, My I-94 is expiring in mar 2023 and my employer is going to file my H1B extension next week. In worst scenario, If my h1b extension gets denied, and if I leave US immediately, Can I travel back to USA with the I-797 and visa stamp which has expiry date till Nov 2024? Will this give me chance to apply for H1b extension again or H1 transfer? Quote Link to comment
Zodiac System Posted February 2 Report Share Posted February 2 Your I-94 has already expired in March 2023. When your employer files for your H1b extension next week, request him to file "nun pro tunc", to cover the lapse in the I-94 dates. Good Luck. Quote Link to comment
