ib09
I have EAD valid for 2 years. I have applied for Advance Parole renewal which is pending since 2022. In this scenario, if I were to leave my job, can I stay in the country for the validity of the EAD? Quote Link to comment
pontevecchio
Your stay will be based on the pending AOS and not on the EAD. As long as you have a pending AOS, you can stay. Quote Link to comment
Attorney_6
Yes, as your ability to remain in the U.S. is based on having a pending I-485 application, not on having a valid EAD or Advance Parole. EAD gives you the authorization to work, and a valid Advance Parole the authorization to travel outside the U.S. while the I-485 is pending. Quote Link to comment
ib09
Thanks. I have a pending I-485 in EB 2 category with my current employer. If I lose my job it may take me a few months to find a job in this market. If in this situation I am unemployed but my I-485 is still pending, there will be no issue staying in the country? pontevecchio
You may need to provide proof of the original or similar job at any time usually closer to the PD becoming current. As stated, you can stay as long as your AOS is pending Quote Link to comment
